Privacy Policy, Terms of Service & Earnings Policy

Effective date: June 23, 2026

1. Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Earnest (“we,” “us,” or “our”), including our website at https://earnest-rho.vercel.app, our browser extension, and all related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1.1 Eligibility

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement. Accounts registered on behalf of minors are strictly prohibited.

1.2 Account Registration

You may be required to create an account to access certain features. You agree to provide accurate, current, and complete information and to keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@earnest-rho.vercel.app if you suspect unauthorized use.

1.3 Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of any component of the Service.
  • Use automated bots, scripts, or other software to manipulate ad impressions, views, or clicks in a fraudulent manner.
  • Interfere with or disrupt the integrity or performance of the Service or third-party data contained therein.
  • Attempt to gain unauthorized access to any account, computer system, or network connected to the Service.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Harvest or collect personally identifiable information from other users without their consent.
  • Use the Service in any manner that could damage, disable, overburden, or impair the Service.

1.4 Intellectual Property

All content, trademarks, service marks, logos, and intellectual property displayed through the Service are owned by Earnest or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only. Nothing in these Terms transfers any intellectual property rights to you.

1.5 Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or us, or for any other reason at our sole discretion. Upon termination, your right to use the Service immediately ceases.

2. Earnings & Rewards Policy

Earnest operates an opt-in advertising model where registered viewers earn a share of ad revenue for verified ad views delivered through the browser extension. This section governs how earnings are calculated, tracked, and paid out.

2.1 How Earnings Are Calculated

When an active campaign ad is displayed to you through the Earnest extension and you engage with it for a verified minimum duration, a “verified view” is recorded. You earn 50% of the campaign’s cost-per-view for each verified view. This amount is added to your lifetime, 30-day, and 24-hour earnings balances tracked in your account.

2.2 Earnings Periods

  • Lifetime Earnings: cumulative total of all verified views earned since account creation. This value never resets.
  • 30-Day Earnings: total earnings within the current rolling 30-day period. Resets at the end of each 30-day period.
  • 24-Hour Earnings: total earnings within the most recent 24-hour window. Resets every 24 hours.

2.3 Verified Views

A view is only counted as “verified” if it meets the minimum engagement threshold defined by the active campaign. Earnest reserves the right to adjust this threshold at any time. Views generated by automated means, bots, or any non-genuine human interaction will be disqualified and may result in account suspension.

2.4 Earnings Adjustments & Disputes

Earnest reserves the right to adjust, withhold, or reverse earnings that result from fraudulent activity, technical errors, chargebacks from advertisers, or violations of these Terms. If you believe an earnings calculation is incorrect, contact us at legal@earnest-rho.vercel.app within 30 days of the event.

2.5 No Guaranteed Earnings

Earnest does not guarantee any minimum level of earnings. Earnings depend on the availability of active campaigns, your usage patterns, campaign budgets, and other factors outside our control. Earnings are a reward for participation — they do not constitute wages, salary, or employment compensation of any kind.

2.6 Payouts

Payout methods, thresholds, and schedules are determined by Earnest and may change at any time with notice. We reserve the right to introduce payout minimums. Unclaimed balances may be subject to expiration as defined in the payout policy published on the Service.

3. Advertiser Terms

These terms apply to any user who creates and funds advertising campaigns on the Earnest platform (“Advertiser”).

3.1 Campaign Creation

Advertisers may create campaigns by specifying a brand name, campaign title, destination URL, logo, bid per block, and number of blocks. Each block represents 1,000 views. The total campaign budget is calculated as bid-per-block multiplied by number of blocks. The cost-per-view is derived from the total budget divided by total views.

3.2 Budget & Billing

Advertisers are charged based on verified views delivered up to the campaign’s total view limit. Once a campaign reaches its view limit it is automatically marked “complete” and ceases to serve. Unused budget is handled per the refund policy below.

3.3 Prohibited Content

Advertisers may not create campaigns that promote:

  • Illegal products or services in any jurisdiction where the Service operates.
  • Adult content, explicit material, gambling, or controlled substances.
  • Hate speech, discrimination, harassment, or violence.
  • Misleading, deceptive, or fraudulent claims.
  • Malware, phishing, or other malicious content.
  • Content that violates the intellectual property rights of any third party.

We reserve the right to reject or remove any campaign at our sole discretion without refund if it violates these standards.

3.4 Refund Policy

Advertiser budgets are generally non-refundable once a campaign is active and delivering views. If a campaign is rejected before launch, a full refund will be issued. For technical errors resulting in over-delivery or under-delivery, Earnest will issue credits or adjustments at its discretion.

4. Privacy Policy

Your privacy is important to us. This Privacy Policy explains how Earnest collects, uses, shares, and protects information when you use our Service. This policy applies to all users — viewers and advertisers alike.

  • To produce anonymized, aggregated analytics used to improve campaign performance reporting.

4.3 Legal Basis for Processing (GDPR)

For users in the European Economic Area (EEA), UK, or Switzerland, we process your data under the following legal bases: performance of our contract with you (account and earnings management); legitimate interests (fraud prevention, service improvement); compliance with legal obligations; and your consent where explicitly given (e.g., optional communications).

5. Data Collection & Sharing

5.1 Data Storage

User data is stored securely using Supabase (PostgreSQL) hosted on infrastructure that meets industry-standard security requirements. Ad interaction data and account information are stored in our database and retained for as long as your account is active, plus a reasonable period thereafter to comply with legal obligations.

5.2 Data We Do Not Collect

  • We do not read, store, or transmit the content of your AI conversations (ChatGPT, Claude, etc.).
  • We do not collect full browsing history outside of the specific pages where the extension activates.
  • We do not sell your personal data to third-party marketers.
  • We do not use your data to build advertising profiles beyond what is necessary to operate the Service.

5.3 Sharing with Third Parties

We may share your information with:

  • Service providers who help us operate the Service (e.g., hosting, authentication, analytics) under strict data processing agreements.
  • Advertisers: only aggregated, anonymized campaign performance data. Advertisers do not receive your personal information.
  • Law enforcement or regulatory authorities when required by applicable law or to protect the rights, property, or safety of our users or the public.
  • Successors in the event of a merger, acquisition, or sale of assets, subject to standard data protection obligations.

5.4 Data Retention

We retain your personal data for as long as your account remains active. If you delete your account, we will delete or anonymize your personal data within 90 days, except where retention is required by law (e.g., financial records). Aggregated, non-identifiable analytics data may be retained indefinitely.

6. Cookies & Tracking

The Earnest website and extension use minimal tracking technologies necessary to operate the Service.

  • Authentication tokens: stored in your browser's local storage to keep you logged in across sessions. These are strictly necessary and do not track browsing behavior.
  • Session data: used to associate ad interaction events with your account for earnings calculation.
  • Extension local storage: stores your earnings state, recent ad activity, and campaign cache locally on your device. This data is not shared with third parties.

We do not use third-party advertising cookies, cross-site tracking pixels, or behavioral advertising networks. You can clear your browser’s local storage at any time to remove all locally stored extension data.

7. Your Rights

Depending on your location, you may have certain rights regarding your personal data:

  • Access: You have the right to request a copy of the personal data we hold about you.
  • Rectification: You have the right to request correction of inaccurate or incomplete data.
  • Erasure: You have the right to request deletion of your personal data ("right to be forgotten"), subject to our legal retention obligations.
  • Portability: You have the right to receive your personal data in a structured, machine-readable format.
  • Restriction: You have the right to request that we restrict processing of your data in certain circumstances.
  • Objection: You have the right to object to processing based on legitimate interests.
  • Withdrawal of Consent: Where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of prior processing.

To exercise any of these rights, contact us at legal@earnest-rho.vercel.app. We will respond within 30 days. We may need to verify your identity before fulfilling your request.
